Welcome to HealthyCal. The developer of HealthyCal ("we", "us" or "our") provides meal logging, food image recognition, calorie and nutrition estimates, activity-burn summaries, trend analysis and subscription services. Read these terms in full before using or purchasing the service. By selecting Agree or completing a purchase, you confirm that you understand and accept these terms. If you do not agree, do not purchase a subscription or use the related cloud services.
1. Nature and scope of the service
1.1 HealthyCal is a general diet and activity tracking tool. It is not a medical device and does not provide diagnosis, treatment, prescriptions, disease prevention or emergency assistance.
1.2 Food names, categories, portions, calories, nutrient values, activity burn and suggestions may be derived from device sensors, third-party health platforms, configured reference data or artificial intelligence estimates. They are for general wellness information only. You must check them against actual portions, product labels and appropriate professional advice.
1.3 If you are not old enough under the laws where you live to accept these terms or consent to the processing of health-related data, a parent or legal guardian must review and accept them for you.
2. Account and acceptable use
2.1 You must provide accurate and lawful account information and protect your login credentials. You are responsible to the extent provided by law for risks caused by voluntarily sharing credentials, using shared devices or failing to sign out.
2.2 You may not upload unlawful, infringing or malicious material; upload unnecessary sensitive content; bypass subscription checks; disrupt servers; scrape at scale; reverse engineer cloud interfaces; or use the service for fraud.
3. Local storage
3.1 In the current version, meal details, calorie and nutrient summaries, profile information, health-data summaries, recognition results and meal photos are primarily stored in app-specific storage on your device so the app can display records, trends and later review.
3.2 Clearing app data, uninstalling the app, system cleanup, device loss, damage or replacement may permanently delete local records and photos. Your operating system may copy some app data through cloud backup or device-transfer features, depending on your device and account settings. Those processes are controlled by the platform.
3.3 We do not promise that local data will be retained indefinitely or can always be recovered. Decide whether you need a separate record of important information. Do not photograph identity documents, payment cards, other people's faces or unrelated sensitive information.
4. Health and activity data
4.1 With your permission, HealthyCal may read activity-burn data from Health Connect, Huawei Health services or other system health interfaces to calculate daily expenditure and energy balance. We access only the data within the permission granted. You can revoke permission in system settings or the relevant health app.
4.2 Health data may be delayed, missing, duplicated or affected by device error. If a connection fails, the app may estimate expenditure from information you provide. Do not use these results as the sole basis for medical, insurance, employment or other high-impact decisions.
5. Cloud AI recognition
5.1 Cloud recognition is a subscription feature. When you actively use it, the app sends a meal photo and information necessary to provide recognition to cloud services. Contracted third-party AI service providers may participate in processing this information to estimate food names, categories, portions, calories and nutrients.
5.2 Under the current implementation, the HealthyCal server does not intentionally retain your uploaded original meal photo as long-term meal-history data. It does retain usage metadata needed to provide and bill for the service, prevent abuse and diagnose faults, such as an account-linked identifier, service region, model, request time, success or failure status and error information. Third-party AI providers may temporarily process or retain requests under our service arrangements, applicable law and their security controls.
5.3 Cloud processing may occur in your account service region or another location permitted by applicable law. We use reasonable measures such as encrypted transport, access controls, least privilege and supplier management, but no network, device or third-party system can be guaranteed absolutely secure.
5.4 AI output may be incorrect, incomplete, inconsistent or misleading, particularly with poor lighting, occlusion, mixed dishes, unknown portions or recipes without a standard composition. You review and adjust results before they are saved, and you are responsible for the content you finally confirm.
5.5 You must have the right to upload each photo. Do not upload another person's personal data, medical records, payment information, children's images or other unnecessary sensitive content. We do not use meal photos for identity recognition or medical diagnosis.
6. On-device recognition
On-device recognition is performed primarily on your device. Unless you actively use cloud recognition, the app does not send the photo to the cloud for food recognition. Recognition results are estimates, may be incomplete or inaccurate, and should be reviewed by you.
7. Subscriptions, prepaid plans and payment
7.1 Available plans, prices, currencies, taxes, durations and offers are those shown and confirmed in Google Play at the time of purchase.
7.2 An auto-renewing plan renews and charges at the end of each billing period under Google Play rules until you cancel it in Google Play. A prepaid plan is available only for its purchased term and does not renew automatically unless you purchase or extend it again.
7.3 You can manage or cancel a subscription through Payments & subscriptions in Google Play. Cancelling auto-renewal generally stops future charges and access continues through the paid term. Refunds, revocation, withdrawal rights and exceptions are governed by Google Play policies and mandatory consumer law where you live.
7.4 After payment, the app and server must verify the purchase with Google Play. Network conditions, payment review, an account-region mismatch, Google Play service issues or third-party delay may temporarily delay activation or restoration.
7.5 A subscription grants a limited, revocable and non-transferable right to use the applicable features during the active term. It does not transfer ownership of software, models or content.
8. Cloud recognition allowance and fair use
8.1 While a subscription is active, each account may use cloud food recognition up to 500 times per UTC calendar month, 20 times per UTC day, and 3 times per rolling minute. Daily and calendar-month allowances reset according to UTC server time. Unused allowance does not carry over to the next period.
8.2 When any limit is reached, cloud recognition is temporarily unavailable, but on-device features remain available. You can view the remaining daily and calendar-month allowance on the Me page. A recognition request counts once the server accepts it and begins cloud processing.
8.3 To control abnormal requests, API abuse and third-party AI costs, we may restrict clearly abnormal automated use. You must not evade allowance limits through multiple app instances, automation, client modification or similar methods.
9. Changes and availability
We may update features, models, interfaces and service regions for security, compliance, performance, supplier availability, cost or product improvement. We will provide notice of material adverse changes when required by law or platform rules. Maintenance, network interruption, third-party failure, force majeure or regulatory requirements may temporarily make the service unavailable.
10. Intellectual property
HealthyCal software, interfaces, marks, text, algorithms, model configuration and other protected materials belong to us or the relevant rights holders. You retain rights in content you lawfully upload and grant us only the licence necessary to process that content to provide, secure and improve the service you request.
11. Disclaimers and limitation of liability
11.1 To the extent permitted by applicable law, the service is provided "as is" and "as available". We do not guarantee that recognition, calorie estimates, nutrition values, trends or suggestions will be completely accurate, uninterrupted or suitable for a particular purpose.
11.2 Do not rely solely on the app for medical treatment, therapeutic diets or decisions that could cause significant harm. Consult a qualified professional if you have a medical condition, allergy, eating disorder, pregnancy-related need or other health concern. Contact local emergency services in an emergency.
11.3 For loss caused by failure to review AI output, breach of these terms, device or network failure, third-party conduct or events beyond reasonable control, our liability is limited only to the extent permitted by applicable law. These terms do not exclude mandatory consumer rights or liability that cannot lawfully be excluded, including liability arising from intentional misconduct or gross negligence where applicable.
12. Data rights and deletion
You can manage local data using available app controls, by clearing app data or by uninstalling the app. Some system backups must be managed separately in your device-account settings. To request access, correction, deletion, restriction or another legal right concerning account data, subscription records or cloud-usage logs, email support@glintmote.com. Records required for law, payment reconciliation, fraud prevention or dispute handling may be retained for the necessary period.
13. Termination
You may stop using the app, cancel a subscription or uninstall at any time. We may lawfully restrict or terminate service if you materially breach these terms, threaten service security, commit fraud or if required by law. Accrued payments, liabilities and provisions that must survive do not automatically end.
14. Updates to these terms
We may update these terms because of changes in features, law or third-party services and provide notice in the app or another legally permitted way. If renewed consent is required for a material change, we will ask you to confirm again. Existing rights and obligations remain governed by the terms and law applicable when they arose.
15. Governing law and disputes
These terms are governed by the law that legally applies. No choice of law or limitation in these terms reduces mandatory consumer or data-protection rights where you live. The parties should first try to resolve a dispute informally. If that fails, either party may use a court or consumer dispute-resolution body with lawful jurisdiction.
